Illinois has cannabis laws that restrict how an employer may respond to a cannabis-positive drug test. The state workers’ compensation law requires compliance with DOT drug and alcohol testing regulations. A separate law exists that mandates and regulates drug testing by public works employers. The workers’ compensation law in Illinois contains its own drug testing requirements. Employers are not required to comply unless they wish to deny workers’ compensation claims.
