New Jersey Governor Signs Legislation Protecting Privacy of Consumer Personal Data

New Jersey Governor Phil Murphy has signed legislation – Senate No. 332/Assembly No. 1971 – that protects consumer privacy by requiring the notification to consumers of the collection and disclosure of personal data by certain entities that include internet websites and online providers, according to a news release on the NJ.gov website dated January 16, 2024.

“In a rapidly growing digital age, our society has become increasingly dependent on the internet to complete day-to-day tasks from shopping and working to deeply personal tasks such as managing finances and medical care,” said Governor Murphy. “However, far too often consumer privacy is exploited without consumers knowing that their data is being shared and sold.”

Under the legislation, entities that collect consumer information are required to notify consumers of the collection and disclosure of personal information to other third parties. Entities must also post a clear and conspicuous link on their website or on another prominent location that allows consumers to opt out of the collection or disclosure of their personal data.

Senate No. 332/Assembly No. 1971 also entitles the consumer to know what data is held by the entity so they can correct or delete incorrect information. The entity also must limit the collection of personal data to what is reasonably necessary to their business and specify the purposes for such data. The act will take effect 365 days after the date of enactment.

“Other states, including California, Colorado, Connecticut, Delaware, Indiana, Iowa, Montana, Oregon, Tennessee, Texas, Utah, and Virginia, have already enacted similar measures, and I am proud New Jersey will join that contingent of states to better protect our residents,” Governor Murphy said in his published statement upon signing the two bills.
